Double Opt-In and Logging
Subscription to our newsletter uses a double opt-in process. This means that after registering, you will receive an email asking you to confirm your subscription. This confirmation is necessary to prevent anyone from subscribing using someone else's email address.
Newsletter subscriptions are logged to document the registration process in accordance with legal requirements. This includes recording the time of registration and confirmation, as well as the IP address. Changes to your data stored with MailChimp are also logged.
Use of the email marketing service "MailChimp"
Our newsletters are sent via "MailChimp," a newsletter distribution platform provided by the US company Rocket Science Group, LLC, 675 Ponce De Leon Ave NE #5000, Atlanta, GA 30308, USA.
The email addresses of our newsletter recipients, as well as their other data described in this notice, are stored on MailChimp's servers in the USA. MailChimp uses this information to send and analyze the newsletters on our behalf. Furthermore, according to its own information, MailChimp may use this data to optimize or improve its own services, e.g., for the technical optimization of newsletter delivery and display, or for business purposes, such as determining the countries of origin of the recipients. However, MailChimp does not use the data of our newsletter recipients to contact them directly or to share it with third parties. We trust in MailChimp's reliability and its IT and data security. MailChimp is certified under the EU-US Privacy Shield Framework and is therefore committed to complying with EU data protection regulations. We have also concluded a Data Processing Agreement with MailChimp. This agreement obligates MailChimp to protect our users' data, to process it on our behalf in accordance with its privacy policy, and, in particular, not to share it with third parties. Statistical Data Collection and Analysis
The newsletters contain a so-called "web beacon," i.e., a pixel-sized file that is retrieved from MailChimp's server when the newsletter is opened. During this retrieval, technical information such as browser and system details, as well as your IP address and the time of retrieval, are collected. This information is used to technically improve the services based on the technical data or to analyze target groups and their reading behavior based on their retrieval locations (which can be determined using the IP address) or access times.
The statistical data collection also includes determining whether the newsletters are opened, when they are opened, and which links are clicked. While this information can be technically associated with individual newsletter recipients, it is neither our intention nor MailChimp's to monitor individual users. Rather, the analyses serve to help us understand our users' reading habits and to tailor our content accordingly, or to send different content based on our users' interests.
Online Access and Data Management
There are instances where we redirect newsletter recipients to MailChimp's website. For example, our newsletters contain a link that allows recipients to view the newsletter online (e.g., if there are display issues in their email program). Furthermore, newsletter recipients can subsequently correct their data, such as their email address. MailChimp's privacy policy is also only accessible on their website.
In this context, we would like to point out that MailChimp's website uses cookies, and therefore personal data is processed by MailChimp, its partners, and service providers (e.g., Google Analytics). Cancellation/Revocation
You can unsubscribe from our newsletter at any time, i.e., revoke your consent. This simultaneously revokes your consent to its distribution via MailChimp and the statistical analyses. Sweepstakes
When conducting and processing sweepstakes, the responsible party processes the names, addresses, and email addresses of the participants. The legal basis for processing personal data in the execution and processing of prize draws is Article 6(1)(a) GDPR (declaration of consent). Beyond this, the personal data of the data subjects will not be disclosed to third parties – apart from the Austrian Post for the purpose of sending the prizes. The personal data of the data subjects (excluding the winners) will be deleted immediately after the evaluation and conclusion of the prize draw, and at the latest within 14 days. The personal data disclosed by the individual winners will be retained for the purpose of answering inquiries regarding the prizes and for the duration of the warranty period (but for no longer than 3 years from the date the prize is sent). Rights of Data Subjects
a) Right to Confirmation
Every data subject has the right granted by the European legislator to obtain from the controller confirmation as to whether or not personal data concerning him or her are being processed. If a data subject wishes to exercise this right of confirmation, he or she may, at any time, contact an employee of the controller.
b) Right of Access
Every data subject has the right granted by the European legislator to obtain from the controller, free of charge, information about his or her personal data stored at any time and a copy of this information. Furthermore, the European legislator has granted the data subject the right to information regarding the following:
the purposes of the processing; the categories of personal data being processed;
the recipients or categories of recipients to whom the personal data have been or will be disclosed, in particular recipients in third countries or international organizations; where possible, the envisaged period for which the personal data will be stored, or, if not possible, the criteria used to determine that period; the existence of the right to request from the controller rectification or erasure of personal data or restriction of processing of personal data concerning the data subject or to object to such processing; the right to lodge a complaint with a supervisory authority;
where the personal data are not collected from the data subject, any available information as to their source; the existence of automated decision-making, including profiling, referred to in Article 22(1) and (4) of the GDPR and, at least in those cases, meaningful information about the logic involved, as well as the significance and the envisaged consequences of such processing for the data subject.
The data subject is not personally identifiable. Furthermore, the data subject has the right to obtain information as to whether personal data has been transferred to a third country or to an international organization. If this is the case, the data subject also has the right to be informed of the appropriate safeguards relating to the transfer.

c) Right to rectification
Every data subject has the right granted by the European legislator to obtain from the controller without undue delay the rectification of inaccurate personal data concerning them. Taking into account the purposes of the processing, the data subject also has the right to have incomplete personal data completed, including by means of providing a supplementary statement.
If a data subject wishes to exercise this right to rectification, they may contact an employee of the controller at any time.
d) Right to erasure (right to be forgotten)
Every data subject has the right granted by the European legislator to obtain from the controller the erasure of personal data concerning him or her without undue delay where one of the following grounds applies, and where the processing is not necessary:
The personal data are no longer necessary in relation to the purposes for which they were collected or otherwise processed.
The data subject withdraws consent on which the processing is based according to point (a) of Article 6(1) or point (a) of Article 9(2) of the GDPR, and where there is no other legal ground for the processing.
The data subject objects to the processing pursuant to Article 21(1) of the GDPR and there are no overriding legitimate grounds for the processing, or the data subject objects to the processing pursuant to Article 21(2) of the GDPR.
The personal data have been unlawfully processed.
The erasure of personal data is necessary for compliance with a legal obligation under Union or Member State law to which the controller is subject.
The personal data were collected in relation to information society services offered pursuant to Article 8(1) GDPR.
If one of the aforementioned conditions is met and a data subject wishes to restrict the processing of their personal data stored by Burgenland Tourismus GmbH, they may contact an employee of the data controller at any time. The employee of Burgenland Tourismus GmbH will then arrange for the restriction of processing.
f) Right to data portability
Every data subject has the right, granted by the European legislator, to receive the personal data concerning them, which they have provided to a controller, in a structured, commonly used, and machine-readable format. She also has the right to transmit this data to another controller without hindrance from the controller to whom the personal data was provided, provided that the processing is based on consent pursuant to Article 6(1)(a) GDPR or Article 9(2)(a) GDPR or on a contract pursuant to Article 6(1)(b) GDPR, and the processing is carried out by automated means, unless the processing is necessary for the performance of a task carried out in the public interest or in the exercise of official authority vested in the controller.
Furthermore, when exercising her right to data portability pursuant to Article 20(1) GDPR, the data subject has the right to have the personal data transmitted directly from one controller to another, where technically feasible and provided that this does not adversely affect the rights and freedoms of others.
To exercise the right to data portability, the data subject may contact an employee of Burgenland Tourismus GmbH at any time.
g) Right to object
Every data subject has the right granted by the European legislator to object, on grounds relating to his or her particular situation, at any time to processing of personal data concerning him or her which is based on point (e) or (f) of Article 6(1) of the GDPR. This also applies to profiling based on these provisions.
In the event of such an objection, Burgenland Tourismus GmbH will no longer process the personal data unless we can demonstrate compelling legitimate grounds for the processing which override the interests, rights and freedoms of the data subject, or the processing serves the purpose of establishing, exercising or defending legal claims.
Where Burgenland Tourismus GmbH processes personal data for direct marketing purposes, the data subject has the right to object at any time to processing of personal data concerning him or her for such marketing. This also applies to profiling to the extent that it is related to such direct marketing. If the data subject objects to the processing of their personal data by Burgenland Tourismus GmbH for direct marketing purposes, Burgenland Tourismus GmbH will no longer process the personal data for these purposes.
Furthermore, the data subject has the right to object, on grounds relating to their particular situation, to the processing of personal data concerning them which is carried out by Burgenland Tourismus GmbH for scientific or historical research purposes or statistical purposes pursuant to Article 89(1) GDPR, unless such processing is necessary for the performance of a task carried out in the public interest.
To exercise the right to object, the data subject may contact any employee of Burgenland Tourismus GmbH directly. The data subject is also free, in the context of the use of information society services, and notwithstanding Directive 2002/58/EC, to exercise their right to object by automated means using technical specifications.
i) Right to withdraw consent under data protection law
Every data subject has the right, granted by the European legislator, to withdraw their consent to the processing of their personal data at any time.
